The following terms and conditions apply to all companies and/or persons or other entities (“you”) that are attending any event (“Event”) organised by the Australian Customer Experience Professionals Association (“ACXPA”, “we” or “us”). Please ensure you have read and understood the following.
By completing the registration form for a particular Event, you are agreeing to the terms and conditions set out below (“Terms”) and they will be incorporated into the contract between us (“Contract”). You will ensure that your employees, partners, agents, contractors, subcontractors and any other person attending the Event on your behalf shall comply with these Terms. The Contract is formed when we send you a booking confirmation.
1. PAYMENT
1.1 The fee for attending the Event will be stated on the ACXPA website. Prices are exclusive of GST except where expressly stated otherwise. All payments for the Event must be made in full at the time of completing the registration form, and in any event prior to the date of the Event unless prior arrangements have been made.
1.2 All fees and charges are payable in Australian dollars ($AUD), via the online payment gateway.
1.3 Where an invoice has been issued for Event payment, our payment terms are strictly 14 days unless agreed in writing prior.
1.4 Under no circumstances will Event attendance be allowed if the invoice has not been paid.
2. CANCELLATION AND REFUND
2.1 If you are unable to attend the Event for any reason you may email us in writing to [email protected] to provide us with the name of a substitute to attend the Event on your behalf and on receipt of this email we shall make such substitution and allow the substitute access to the Event, noting that the terms and conditions contained herein also apply to any substitution.
2.2 If you are unable to attend the Event and wish to cancel your enrolment, all cancellations must be in writing [email protected] and the effective date of the notice of cancellation is the date it is received by ACXPA to the nominated email address (“Effective Date”).
2.3 If the notice of cancellation is received from the Effective Date which is:
• more than 28 days* prior to the Event commencement date: 100% of the Event fee will be refunded except for any out of pocket expenses already incurred by us if Event materials have been sent out of which the cost will be deducted from any refund;
• between 14 – 28 days* prior to the Event commencement date: 75% of the Event fee will be refunded except for any out of pocket expenses already incurred by us if Event materials have been sent out of which the cost will be deducted from any refund;
• between 3 – 14 days* prior to the Event commencement date: 50% of the Event fee will be refunded except for any out of pocket expenses already incurred by us if Event materials have been sent out of which the cost will be deducted from any refund; and
• Less than 3 days* prior to the Event commencement date: you will forfeit 100% of the event fee (remember you can still substitute with another person).
* Refers to all days, including weekends and public holidays.
3. CANCELLATION BY ACXPA
3.1 Whilst we hope it never occurs, ACXPA reserves the right to cancel any Event should a presenter unexpectedly become ill or there is an emergency; in the event of exceptional circumstances; or if there are insufficient numbers to make the event viable. ACXPA will give as much notice as practicable in the given circumstance.
3.2 Where cancellation of a Event occurs, ACXPA will provide you with:
3.2.1 A full refund of the amount of the registration fee that you have paid to us, and we will make every effort to provide you with such refund within 7 days of the date of cancellation. Or;
3.2.2 A credit of the full amount of the registration fee that you have paid to us that can be used towards any of the other ACXPA events within a 12 month period from the credit being issued. Failure to use the credit within the 12 months of issue will forfeit the amount.
3.3 There may be circumstances in which we need to postpone the Event and if we do, we shall advise you of this as soon as we possibly can. If the postponement is for more than 3 months after the publicised date of the Event you may cancel your registration by emailing us at [email protected] and we shall provide you with a full refund.
3.4 ACXPA sole liability in relation to any cancellation or postponement shall be limited to the price paid by you for such Event and we shall not be liable under any circumstances for any consequential losses.
4. YOUR OBLIGATIONS
4.1 If you act in any way which in our opinion is likely to cause any harm or nuisance to any person at the Event, you will be required to leave the Event and we shall not be liable to refund your registration fee or any other payment.
4.2 You must comply with all requests from us with regard to health and safety and failure to do so will result in you being asked to leave the Event (in which case no refund will be provided).
5. MATERIALS AT THE EVENT
5.1 We will endeavour to send you any workbooks or Event materials prior to the Event commencement date, however, if you register 14 days prior to the Event commencement date, or there are any delays that are beyond our control including due to effects of a pandemic, then we will email you the workbooks and Event materials which can be printed at your own cost and expense.
5.2 Unless otherwise stated, the copyright and all other such intellectual property rights for any materials used at the Event (including event notes, slides, brochures, articles and case studies) belongs to us and may not be reproduced in any medium without our prior written consent.
5.3 You may use such materials for your own business purposes only and may not reproduce, publish or deal with such materials in any way for any commercial use.
5.4 We reserve the right to change the published programme (including the publicised speakers) or materials as we think fit.
5.5 We do not make any representation, guarantee or commitment to you that the Event materials will be error-free.
5.6 We do not make any commitment that the Event materials will be compatible with or operate with your software or hardware.
5.7 All representations, warranties and/or terms and/or commitments not expressly set out in these Event terms and conditions (whether implied by law, conduct, statute or otherwise) are hereby excluded to the maximum extent permissible at law.
6. PHOTOGRAPHY AND FILMING
6.1 We may wish to photograph or film the Event and reserve the right to do so for the purposes of promoting future Events or otherwise. You consent to us (or any other person attending the Event) photographing or filming you and any persons attending the Event with you.
6.2 You may not photograph, video or record the Event without our prior consent.
6.3 We may request a testimonial; however, you do not have to provide one.
7. TICKETS
7.1 Once you have paid for the Event a meeting identification will be sent to you to enable access to the Event. You will be responsible for downloading the video communication platform as advised by ACXPA prior to the Event commencement.
7.2 All online meeting details will be supplied to you prior to the Event commencing.
7.3 All internet connections and connectivity is your responsibility. Should your internet fail we are not liable for you missing the Event.
7.4 If our connectivity fails and the Event is unable to be presented appropriately, we will reschedule either all or parts, as applicable, of the Event that was unavailable.
8. SPECIAL REQUIREMENTS
8.1 If you have any disability or medical condition that requires us to make special arrangements for you, please email us at [email protected] as soon as possible and in any event at least 2 weeks prior to the date of the Event.
9. LIMITATION OF LIABILITY
9.1 We shall not in any way be liable for any loss, damage, cost or expense suffered by you whatsoever in relation to the Event, save that nothing in these Terms shall be deemed to limit the liability of any person for death or personal injury caused by negligence.
9.2 ACXPA total liability for any matter arising out of the Contract shall in all circumstances be limited to the price paid by you for the Event and we shall not in any circumstances be liable to you for any consequential loss whatsoever.
10. DISCLAIMER
10.1 The Event is for training purposes only. We will not accept any responsibility to any party for the use of the Event or the Event materials for any purpose other than training for educational purposes, including but not limited to, the giving of advice by you to any third party.
11. GOVERNING LAW
11.1 These Terms shall be governed by laws of Victoria and you hereby submit to the exclusive jurisdiction of the Victorian Courts.
